1.3.2.Customer – a natural or legal person who orders goods at www.vinoga.lv, who is 18 years of age and has unlimited legal capacity to enter into a contractual relationship with Vīnoga.lv;
1.3.3.VĪNOGA.LV – online sales site www.vinoga.lv, which is used by the Customer for placing an order;
1.3.4.Delivery – Delivery of the goods ordered by the Customer within the hours 8-22 to the address specified in the Customer's order;
1.3.5.Delivery Package – Package in which the products of the Customer's choice are delivered at the time of delivery;
2.1. The Customer may use the services of VĪNOGA.LV only if they are registered. When placing an order, the Customer must provide the following information: name, contact details and exact delivery address.
2.2. When ordering goods, the Customer is responsible for providing true and correct information. In accordance with the laws and regulations of the Republic of Latvia. At the time of delivery, a personal identification document must be presented to confirm the Customer's legal age and the right to purchase alcoholic beverages.
2.3. Notices of order fulfilment (e.g. order confirmation, invoice, order cancellation, etc.) will be sent to the Customer regardless of the fact that they have chosen not to receive notifications and offers as these notices are necessary for order fulfilment and informing the Customer of the order status.
3. Price, charges and delivery costs
3.1. The prices of the goods in VĪNOGA.LV are quoted in EUR. All prices are inclusive of any value added tax or tax. Goods are sold at prices valid at the time the order is placed. The bank fee may apply depending on the bank used by the Customer.
3.2. In addition to the price, if the order amount is less than EUR 5, the Customer will have to pay the delivery fee for the courier delivery service in the amount of EUR 5 to the specified address within the territory of Riga. The delivery charge is not applicable if the total price of the goods exceeds EUR 50,00.
3.3. The Customer may only pay using the payment methods specified in the menu of VĪNOGA.LV payment methods. Payment must be made before the goods are received.
3.4. After receiving the order VĪNOGA.LV sends the customer an order confirmation by e-mail.
4. Compilation and delivery of goods
4.1. VĪNOGA.LV makes every effort to ensure that each order is fully executed, however, due to the unavailability of certain products at the time of order execution, VĪNOGA.LV does not warrant that all products ordered by Customer will be available and delivered.
4.2. Delivery will be made to the address specified by the Customer at the time of placing the order. VĪNOGA.LV will deliver the Customer's order to the main entrance to the delivery address. At the Customer's request, the supplier may bring the order to the delivery address, for example, to a specific floor in an apartment building, only if:
4.2.1. the supplier has the Customer's consent; and
4.2.2. our supplier believes that it is safe and practical to fulfil such Customer's request. VĪNOGA.LV always reserves the right to deliver the order to the main entrance of the address.
4.3. For deliveries to the Customer’s business address, VĪNOGA.LV can only ensure delivery to the main entrance on the first floor of the business.
4.4. Delivery is available to an adult who is at least 18 years old and has proof of age. If no document of proof of age is available and there is no person of at least 18 years of age at the delivery address at the time of delivery, the goods will remain with the supplier.
4.5. Documents of proof for goods purchased at www.vinoga.lv:
4.5.1 In cases where the product ordered on the website www.vinoga.lv are paid for and received at the address Baznīcas Street 39A-1, Riga, the following documents confirming the purchase of the goods are issued:
126.96.36.199. Cashier’s check;
188.8.131.52. Consignment note.
4.5.2 In cases where the ordered item is delivered to the address specified by the buyer, the proof of purchase is the consignment note which is sent to the e-mail indicated in the order of the respective goods.
4.6. The fact that the buyer has received the product is evidenced by:
4.6.1. Upon receipt of the ordered product at www.vinoga.lv store in 39A-1 Baznīcas Street, Riga - Customer's signature on the document;
4.6.2. Upon receipt of the ordered product with delivery – the Customer's signature on the document.
4.7. Claims that the order has not been delivered after the order has been confirmed by one of the methods described in Clause 4.6. will not be accepted.
4.8. In cases where we deliver an order to the Customer but there is no one at the address who could receive the order, the Customer will be notified, and the Customer will need to contact us to arrange a new delivery time. In such cases, if Vīnoga.lv has to return the order, the Customer is obliged to pay the delivery costs.
4.9. VĪNOGA.LV makes every effort to ensure that Customer's order is delivered. VĪNOGA.LV assumes no liability if this deviation is due to Customer or other unavoidable circumstances.
5. Quality guarantee and liability
5.1. The goods displayed on www.vinoga.lv may not conform to the goods received in terms of shape and colour, due to the nature of the technical means used to place the Customer's order or other reasonably foreseeable irregularities.
5.2. The manufacturer and/or distributor of the goods is responsible for all information regarding the characteristics of the VĪNOGA.LV products. VĪNOGA.LV shall be solely responsible for the disclosure of this information to Customers, unless otherwise provided by normative enactments.
6. Withdrawal rights and right of withdrawal
6.1. The Customer shall have the right to unilaterally exercise the right of withdrawal within 14 days of receipt of the order with immediate notice to Vīnoga.lv. The right of withdrawal may be exercised in accordance with the laws and regulations of the Republic of Latvia, The Customer is responsible for the cost of returning such orders.
6.2. VĪNOGA.LV has the right to request that the Customer, upon refusing the goods, return them to the VĪNOGA.LV store from which the delivery was made. The Customer shall bear all costs related to the return of the goods.
6.3. When returning goods to the store, the goods must be undamaged in their original packaging, unopened, within + 1 day of the term of validity. If the Customer cannot meet these requirements, VĪNOGA.LV reserves the right not to pay the Customer for the returned goods.
6.4. If, after receiving the order, the Customer determines that the order is defective and/or of poor quality, the Customer shall apply to VĪNOGA.LV with an application, which shall be accompanied by a photograph of the defective product and VĪNOGA.LV will arrange for a refund to the Customer's account from which the purchase was made. VĪNOGA.LV reserves the right to request the Customer to return all defective goods to the store from which the delivery was made.
7. Order Cancellation
7.1. In case of serious circumstances, VĪNOGA.LV may temporarily or permanently suspend internet sales without prior notice to the Customer. In such cases, VĪNOGA.LV will reimburse the Customer for the undelivered orders within 10 business days.

9. Final provisions and dispute settlement
9.4. In the event that any of the clauses contained in these terms and conditions cease to have effect, the other terms and conditions shall not be affected.
9.5. All intellectual property rights in regard to the website www.vinoga.lv belong exclusively to SIA “Vīnoga.lv”. In case of violation of these rights, the guilty party shall be held liable in accordance with the laws and regulations and shall be fully liable for any damage that has been or could be caused to SIA “Vīnoga.lv” and third parties.
